New Amendments to the False Claims Act
In connection with its compliance plan oversight obligations, the board (and especially the compliance committee) should be familiar with, and address, the organizational implications of the new amendments to the False Claims Act, signed into law by President Obama on May 20, 2009. Michael W. Peregrine and Joshua T. Buchman, partners, McDermott Will & Emery, LLP present a series of talking points the general counsel can use when briefing the board on these new amendments.
Managing the Margin through Quality
Managing the margin through quality (specifically, more efficient clinical delivery) has become a critical component of the healthcare revenue cycle. However, we often overlook it in the midst of this churning and evolving healthcare environment. Typically, labor is tagged as the most expensive line item. The truth is, significant financial potential is hidden in clinical gaps.

A Challenge to Non-Profit Boards
Adam Smith, arguably the father of formal economic theory, referenced the “invisible hand” in his prescient work published in 1789. Smith believed that individuals who compete for self-interest and private gain are “led by an invisible hand” to promote the public good.
Daniel K. Zismer, Ph.D., associate professor & director, Executive Studies Program, School of Public Health, University of Minnesota and managing principal, Essentia Health Consulting,applies Smith’s theory to the U.S. not-for-profit, community-based system of healthcare delivery, arguing that not-for-profit community healthcare organizations will need to focus even more on “their own interests” if they intend to maintain missions of benevolence to the public.
